Minimum Advertised Price Policy
All Cuddles N Giggles Wholesale Accounts should promote and protect Cuddles N Giggles brand as well as operate to Cuddles N Giggles standard and expectation. In order to protect that integrity, the following Minimum Advertised Price Policy (“MAP Policy”) outlines what is required in order to uphold that standard and expectation. This Policy will help ensure that Cuddles N Giggles products are appropriately promoted in the marketplace and ensure the brand equity associated with our products.
Retailers must be authorized by Cuddles N Giggles to sell its products in any location, including brick and mortar and/or on the internet. Retailers are expected to agree and adhere to the following conditions of the MAP Policy in order to avoid potential consequences of non-compliance.
Cuddles N Giggles MAP Policy Guidelines
Products with MAP pricing can be found on your current price list. All advertised prices must be at or above MAP for all products if a MAP price has been established. If a price is listed in an advertisement it must be at or above MAP.
Retailers are also responsible for ensuring their pricing is at or above MAP on internet search engines. Cuddles N Giggles MAP policy for all products apply to advertising placements, including but not limited to: print ads (inserts, magazines, newspapers, catalogs, mail order catalogs, etc.), broadcast (radio and TV), direct mail, faxes, internet placement with third parties (banner ads, broadcast emails, destination pages, third-party sites), internet placements on resellers own website, and any flyers, posters or coupons.
Retailers cannot advertise discounts of over 10% off of MSRP, with the exception of first-time purchase discount offered for new customer sign ups and Black Friday/Cyber Monday sales.
All Cuddles N Giggles retailers that need to clear their stock by offering discount on the MSRP shall obtain prior written consent from Cuddles N Giggles, which shall not be unreasonably denied but preferably granted on a semiannual basis.
Advertising that in any way suggests or implies a price lower than MAP will be considered a violation of this Policy. The following are some examples of possible policy violations:
- Buy One Get One Promotions (“BOGO”): Cuddles N Giggles products included in this type of promotion must maintain MAP and be excluded from the discount or free price
- If Cuddles N Giggles product is considered a free gift or a reduced-price product along with purchase of any other purchase from your shop
- Advertisements indicating that a lower price may be found at the checkout stage
- Store or website wide sales that do not exclude Cuddles N Giggles products
- Store Coupons not excluding Cuddles N Giggles products
- Free giveaways of Cuddles N Giggles’ products for Retailer’s brand and store promotions
From time to time, Cuddles N Giggles may permit resellers to advertise MAP Products at prices lower than the MAP price. In such events, Cuddles N Giggles reserves the right to modify or suspend the MAP price with respect to the affected products for a specified period of time by providing advance notice to all retailers of such changes.
Our wholesale prices and price lists of products made available by Cuddles N Giggles shall be deemed as Confidential Information, to be used by the retailers only. Publishing, revealing, or disseminating any Confidential Information disclosed to the retailers is strictly prohibited without prior written consent from Cuddles N Giggles.
Failure to comply with the MAP Policy
This policy is enforced at the sole discretion of Cuddles N Giggles; failure to comply with MAP, intentional and/or repeated failure to abide, may result in the immediate loss of Authorized Reseller status and your ability to purchase products with a MAP both direct as well as through distribution.
Free Offers PERMITTED with Cuddles N Giggles Products
Free shipping and/or handling, 0% sales tax, or free financing promotions do not violate the MAP.
This Policy may be updated, revised, or modified at any time at the sole discretion of Cuddles N Giggles.
